Liability Waiver & Assumption of Risk

This Liability Waiver and Assumption of Risk Agreement ("Waiver") is entered into between you ("Participant") and LocalRec ("Organizer"). It applies to your participation in any pickup soccer game, session, or event organized, facilitated, or hosted through the LocalRec platform ("Activity").

If you have booked spots for additional friends through the Platform, you represent and warrant that you have obtained their informed consent and that they agree to be bound by this Waiver. You accept this Waiver on their behalf.

Soccer and other physical sporting activities involve inherent risks of injury that cannot be eliminated, even with reasonable precautions. By participating, you acknowledge and accept these risks, which include but are not limited to:

You freely, voluntarily, and knowingly accept and assume all risks — both known and unknown — associated with participating in the Activity, including those described above. You acknowledge that:

• Participation in soccer is physically demanding and potentially dangerous.
• You are participating voluntarily and of your own free will.
• The Organizer has not made any representations that the Activity is safe.
• Even with precautions in place, injury may occur.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE:

• LocalRec and its owners, operators, directors, officers, and employees;
• Any host or organizer of the specific game session;
• The venue and its owners, operators, and staff;
• Any volunteers, referees, or other officials;

(collectively, the "Released Parties") from any and all claims, demands, losses, liabilities, and causes of action arising out of or related to your participation in the Activity, including those caused by the negligence of the Released Parties, whether known or unknown, foreseen or unforeseen.

This release includes, without limitation, claims for:

• Personal injury, illness, death, or disability
• Property damage or loss
• Emotional distress
• Any other loss or harm you may suffer

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your breach of this Waiver or the Terms of Service;
• Your negligent or intentional misconduct during the Activity;
• Any injury or harm caused by you to another participant or third party;
• Your violation of any venue rules or applicable law.

By accepting this Waiver, you represent and warrant that:

• You are in adequate physical health and fitness to participate in soccer.
• You are not aware of any medical condition that would make participation inadvisable.
• You have consulted with a physician if you have any doubts about your fitness to participate.
• You are 18 years of age or older.
• You will disclose any pre-existing medical conditions to emergency responders if needed during the Activity.

The Organizer does not provide medical advice. Participation is at your own medical risk. We strongly encourage participants to carry personal health or activity-specific insurance.

You acknowledge and understand that:

• LocalRec does not provide personal injury insurance, medical insurance, or any other insurance coverage to participants.
• Any medical expenses incurred as a result of participating in the Activity are your sole responsibility.
• You are encouraged to obtain your own personal accident or sports insurance prior to participation.
• Saskatchewan Health coverage (if applicable) may not cover all costs associated with sports injuries.

You participate in the Activity at your own risk with respect to your personal belongings. The Released Parties are not responsible for the loss, theft, or damage of any personal property brought to any venue, including but not limited to mobile phones, wallets, keys, clothing, equipment, or vehicles.

In the event of an emergency where you are unable to communicate, you consent to the Organizer, host, or venue staff seeking emergency medical assistance on your behalf. You acknowledge that emergency costs are your sole responsibility. You agree to provide emergency contact information to the Platform and keep it current.

If any provision of this Waiver is found to be invalid, illegal, or unenforceable under Saskatchewan law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

This Waiver, together with the LocalRec Terms of Service and Privacy Policy, constitutes the entire agreement between you and the Organizer with respect to the subject matter herein. This Waiver supersedes all prior agreements, representations, and understandings relating to participation in the Activity.

This Waiver shall be governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. Any disputes arising under this Waiver shall be resolved in Regina, Saskatchewan.

BY CHECKING THE ACCEPTANCE BOX IN THE REGINA PICKUP SOCCER APPLICATION AT THE TIME OF BOOKING, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS WAIVER IN ITS ENTIRETY, THAT YOU UNDERSTAND ITS TERMS, AND THAT YOU VOLUNTARILY AGREE TO BE BOUND BY IT. YOU ARE WAIVING IMPORTANT LEGAL RIGHTS INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.
