Terms of Service

LocalRec ("we", "us", or "our") operates a mobile application that connects players and hosts for organized pickup soccer games in Regina, Saskatchewan, Canada. We act as the organizer and operator of games hosted through our Platform. Hosts are individuals who create and manage game sessions using our tools.

• You must be at least 18 years of age to create an account or participate in any game on the Platform.
• By using the Platform, you confirm that you meet the age requirement and that all information you provide is accurate and current.
• We reserve the right to suspend or terminate accounts that do not meet eligibility requirements.

• You register using your mobile phone number. A one-time verification code is sent via WhatsApp (powered by Twilio).
• You are responsible for maintaining the security of your account. Do not share your verification codes with others.
• You agree to notify us immediately at support@localrec.ca if you suspect unauthorized use of your account.
• We are not liable for any loss or damage arising from your failure to secure your account.

All participants are expected to conduct themselves in a respectful, fair, and sportsmanlike manner. By joining any game on the Platform, you agree to the following:

• Play fairly and within the spirit of the game.
• Treat all other players, hosts, and venue staff with courtesy and respect at all times.
• Refrain from any form of harassment, hate speech, discrimination, or threatening behaviour.
• Avoid dangerous, malicious, or excessively aggressive play that may injure others.
• Follow all venue rules and instructions from venue staff.
• Arrive reasonably on time. Repeated late arrivals may affect your booking privileges.

Violations of the Code of Conduct may result in:

• Removal from the game by the host without refund.
• A temporary suspension from the Platform.
• A permanent ban from the Platform at our sole discretion.

• Hosts may create and manage game sessions through the Platform subject to these Terms.
• Hosts are responsible for ensuring their game details (venue, time, format, skill level) are accurate at the time of posting.
• Hosts agree to appear at the venue at the scheduled time. Repeated host no-shows may result in loss of hosting privileges.
• Hosts may remove players for conduct violations per Section 6. Removal by a host does not automatically entitle the removed player to a refund.
• Hosts do not set or receive platform fees. Earnings (where applicable) are disbursed by us following game completion, net of processing fees.

• All content on the Platform — including the name, logo, design, graphics, and software — is owned by or licensed to LocalRec and is protected by applicable Canadian intellectual property laws.
• You may not copy, reproduce, distribute, or create derivative works from any Platform content without our express written permission.
• User-generated content (such as profile information) remains your property, but you grant us a non-exclusive, worldwide, royalty-free licence to use it for the purpose of operating the Platform.

Photos and videos may be taken during games for the purpose of promoting the Platform and growing the Regina pickup soccer community. By participating in any game, you consent to the capture and use of such images or footage by us. If you do not consent, please inform us at support@localrec.ca prior to the game.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY GAME.
• OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 30 DAYS PRECEDING THE CLAIM.
• WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR ERROR-FREE ACCESS TO THE PLATFORM.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under Saskatchewan or Canadian law.

• The Platform is provided "as is" and "as available" without warranties of any kind.
• We do not warrant that the Platform will be free of errors, viruses, or other harmful components.
• Physical activity involves inherent risk. See the Liability Waiver for full details.

• These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein.
• Any dispute arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation. If unresolved, disputes shall be referred to binding arbitration in Regina, Saskatchewan under the applicable rules of the ADR Institute of Canada.
• You agree that any claim must be brought in your individual capacity, not as a plaintiff or class member in any class action.

We may update these Terms from time to time. When we do, we will post the revised Terms on the Platform and update the Effective Date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
